Terms and Conditions

1. All persons (“Participants”) entering the KEMPSTON LADIES NITE RACE Competition (“Lucky Draw”) agree that the rules as set out in these terms and conditions (“Terms and Conditions”) are binding on them.

2. A Participant being a person who has entered the KEMPSTON LADIES NITE RACE (the “Event”) by completing the entry form, payment of the entry fee and participation in the Event, in compliance with the terms and conditions of entry, set out on the entry form.

3. The Lucky Draw will be available for entry by Participants of the Event only, after which the Lucky Draw will automatically lapse and no further entries will be accepted.

4. The “Promoter” shall mean the Companies commonly known as the KEMPSTON GROUP (comprising of Kempston Investments (Pty) Ltd; Kempston Cleaning Services (Pty) Ltd, Garrett Assemblies CC; Vincemus Investments (Pty) Ltd; Kempston Trading (Pty) Ltd; Decillion Capital (Pty) Ltd; VINCOT Trust; Ronnies Motors Trust; Edcot Trust; Kempston Motor Group Trust; and VANCOT Trust) & OXFORD STRIDERS RUNNING CLUB.

5. To enter the Lucky Draw, Participants must, HAVE ENTERED AND PARTICIPATED IN THE 5KM FUN RUN OR 10KM RACE. Place their completed entry form into 1 (one) of the 2 (Two) entry boxes at the Event on the 04 MARCH 2023 before 19:00 (the “Lucky Draw Participant”). Entry into the Lucky Draw is limited to 1 (One) entry per Participant.

6. The Lucky Draw will take place on the 04 MARCH 2023, at the Event after the 10km race has been concluded.

7. The Lucky Draw will be an attendance draw, meaning the Lucky Draw Participant MUST be present at the time of the Lucky Draw to be eligible for the prize. The draw will take place at the prize giving held after completion of the Ladies 10km race. KEMPSTON GROUP employees and their immediate family members are EXCLUDED from entering the Lucky Draw. The Lucky Draw winner, upon the announcement of the winner by the Promoter, must immediately identify themselves as being present at the Lucky Draw and report to the Promotors representative. In the event that the Lucky Draw winner does not report to the Promotors representative within 5 (Five) minutes of the announcement of the Lucky Draw winner, the Promoter shall randomly select a replacement winner from the prospective Luck Draw Participants. In the event that the replacement winner fails to report to the Promoters representative within 5 (Five) minutes as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner.

8. The Lucky Draw Participants stand a chance to win the Lucky-Draw prizes (the “Prize”) subject to the following conditions:

a. the Promoter’s decision is final and binding and no correspondence will be accommodated on any matter;

b. relating to the awarding of the Prize, the Prize content, the winning Participant or any other related matter;

c. any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws; and

d. the winner must be willing to sign all indemnities and meet all requirements to redeem the Prize.

e. The Prize is inclusive of only those items listed on the competition flyer, anything not specified in the competition flyer is excluded, including but not limited to transportation.

9. The Prize is non-transferable, cannot be sold or used in conjunction with any other promotional competition or redeemed in whole or part for cash.

10. The Promoter reserve the right to substitute the Prize with another of greater or equal value.

11. The Lucky Draw is open to all South African residents aged 18 years or older. This Lucky Draw is not available to the directors, members, partners, promotional and advertising agents, merchandisers, employees of the KEMPSTON GROUP and/or their immediate family members.

EXCLUSIONS AND OTHER IMPORTANT TERMS

12. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participants or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).

13. The Lucky Draw Participant acknowledges that by submitting his or her entry to the Lucky Draw he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.

14. All Lucky Draw Participants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Participants; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Lucky Draw and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.

15. The Promoter reserve the right to amend these Terms and Conditions as well as terminate the Lucky Draw at any time. In the event of such termination, all Participants agree to waive any rights that they may have in terms of the Lucky Draw and acknowledge that they will have no recourse against the Promoter, its advertising agencies, advisors, suppliers and nominated agents.

16. By entering the Lucky Draw in accordance with its terms, Participants acknowledge that the Lucky Draw will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoter to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.

17. The names of the winner/s will be published on the Promoter’ website and/or social media platforms, the Lucky Draw Participant, in completing the entry form and submitting the entry form into the entry box thereby consents to their personal information and/or photograph being published, as set out herein.

18. The Promoter shall conduct the Lucky Draw, and the Promoter’ decision on any matter related thereto, including the selection of winners is final.

19. The Promoter reserve the right to circulate the Participants personal information for purposes of this Lucky Draw and the Participant, by electing to participate in this Lucky Draw hereby irrevocably and unconditionally consents to the processing, storage, distribution and/or further processing of its personal information as defined in the Protection of Personal Information Act, 4 of 2013 for the purposes contemplated herein.

20. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
